Itemo Listing Policy

1. Introduction

This Itemo Listing Policy sets out the rules and expectations for all users who create and publish item listings on the Itemo platform. It forms part of the Itemo Terms of Service and must be complied with at all times.

By listing an item on Itemo, you ("Owner") agree to abide by this Listing Policy, as well as the Itemo Terms of Service and Privacy Policy.

The objective of this Policy is to ensure listings are legal, accurate, safe and appropriate, protect users, and promote trust and confidence in the Itemo community.

This Policy is designed to comply with applicable UK law and regulations, including the Online Safety Act 2023, the Consumer Rights Act 2015, UK data protection law (UK GDPR & DPA 2018) and other relevant safety and commerce law.

Definitions

  • Listing: An item published on Itemo available for hire.
  • Owner: A user who lists an item.
  • Renter: A user who hires an item.
  • Platform: The Itemo app and associated digital services.

2. Listing Eligibility

2.1 Only Eligible Users

You must be at least 18 years old and have completed your Itemo account before you can create a listing.

To list an item, your account must have completed all relevant verification required by Itemo.

2.2 Eligible Items

An item may be listed only if it:

  • Is lawfully owned by you and you have the right to make it available for hire.
  • Is in a safe and serviceable condition with no undisclosed defects.
  • Is accurately valued and priced for fair use.
  • Falls within the Itemo item categories permitted at the time of listing.

2.3 Restricted & Prohibited Items

You must not list any item that:

  • Is illegal to own, hire or use in the UK.
  • Requires specialist certification, licensing, or insurance that cannot be provided through standard Itemo processes (e.g. heavy machinery requiring certified operators).
  • Violates public health, safety or environmental restrictions in your local area.
  • Is copyrighted or branded in a way that you do not have rights to use (e.g., unlicensed branded media, counterfeit goods).

Examples of the items that users may not list or rent:

Illegal or Dangerous Items

  • Weapons (knives, guns, batons, explosives)
  • Drugs, drug paraphernalia
  • Stolen goods
  • Fireworks or explosives
  • Hazardous chemicals
  • Flammable materials

Adult or Restricted Content

  • Adult toys
  • Pornographic materials
  • Items intended for adult-only activity

High-Risk Items

  • Medical devices
  • Prescription health equipment
  • Items requiring licences (unless user provides proof)
  • Live animals
  • Vehicles requiring insurance or licensing (cars, motorbikes)

Other Prohibited Categories

  • Financial instruments
  • Identity documents
  • Surveillance devices designed for covert recording
  • Anything illegal under UK law

Itemo may expand this list at any time.

Itemo reserves the right to remove any listing it deems unsafe, inappropriate or unlawful.

3. Listing Accuracy & Transparency

3.1 Accurate Descriptions

All listing details must be truthful and complete. Owners must clearly describe:

  • The item's condition if not great using the listing description
  • Any faults, damage, or wear
  • How and where the item is to be collected and returned
  • Any special requirements (e.g., tools needed, transport considerations)

Misrepresentation of an item is prohibited.

3.2 Photos

Every listing must include:

  • At least three clear photos showing the item from multiple angles
  • Close-ups of any noticeable wear or imperfections
  • The three minimum photos must be of the actual item and not stock images. Additional images may include stock images.

Images must not be misleading, altered in a way that conceals defects, or infringe the rights of any other person.

3.3 Pricing

Owners must set pricing in:

  • Pounds Sterling (GBP)
  • Clear per-day or per-week or per-month rates
  • Fees for optional add-ons (e.g., protective equipment) must be clearly indicated

Prices must not be unfairly discriminatory or exploitative.

4. Safety, Maintenance & Suitability

4.1 Safety Requirements

Items must be:

  • Free from hazards
  • Functionally sound and safe for normal use
  • Appropriate for the advertised purpose

Owners must ensure that any safety-related accessories (e.g., helmets, harnesses, manuals) are available if relevant to safe use.

4.2 Maintenance Standards

Owners are responsible for maintaining items in suitable condition and addressing any known defects prior to listing.

Failing to maintain an item that results in renter injury or damage is a breach of this Policy.

5. Compliance with UK Law

5.1 UK Safety & Consumer Standards

Itemo listings must comply with applicable UK consumer safety standards and laws. Owners must ensure that:

  • Items that require safety certification meet UK regulatory standards (e.g., electrical appliances with CE/UKCA marks).
  • Appropriate safety information is provided with the item.

5.2 Online Safety Act 2023

Itemo listings must not include content that:

  • Facilitates illegal activity
  • Encourages unsafe use or provides harmful instructions
  • Contains abusive, hateful, harmful or defamatory content
  • Promotes or assists wrongdoing

Owners must ensure any textual or visual content in their listings complies with Itemo standards and the UK Online Safety Act.

6. Owner Obligations & Responsibilities

6.1 Responsive Communication

Owners must:

  • Respond promptly to renter enquiries
  • Confirm or decline booking requests in a timely manner
  • Communicate collection and return details clearly

6.2 Handover Duties

At handover, owners must:

  • Meet the renter at the agreed time/place
  • Complete the handover checklist fully
  • Explain any operational nuances of the item or any other information

6.3 Post-Hire Conduct

Owners must participate in any dispute processes in good faith and provide evidence where requested.

Owners must not retaliate, harass, mislead or discriminate against renters.

7. Renter Obligations & Listing Interactions

7.1 Respectful Behaviour

Renters must treat owners, their property and their items with respect.

Renters must follow the operational instructions provided by owners and Itemo policies.

7.2 Damage & Disputes

Renters must report damage immediately and cooperate with Itemo dispute resolution.

Renters must not knowingly misuse the platform or items.

8. Moderation, Enforcement & Removal

Itemo reserves the right to monitor and moderate listings. Itemo may suspend or terminate accounts at any time with reasonable notice where practicable, except where immediate action is required for safety, legal, or fraud reasons for:

  • Illegal content
  • Fraud or attempted fraud
  • Prohibited items
  • Abusive behaviour
  • Repeated violations of policy
  • Safety risks
  • Any action harmful to Itemo or its users

A three-strike policy applies to minor violations.

Serious violations result in immediate removal.

Violating this policy may lead to:

  • Temporary suspension
  • Permanent account termination
  • Financial liability for costs or damages caused

Itemo's decisions on moderation are final, subject to appeal via defined support channels.

9. Reporting & Review Process

9.1 Reporting Unsafe or Unlawful Listings

Owners and renters may report any listing that appears:

  • Unsafe
  • Misleading
  • Unlawful
  • Abusive or harmful

9.2 Review & Resolution

Itemo will investigate reports within defined timeframes, usually:

  • Acknowledgement of report: within 24 hours
  • Preliminary decision: within 3–5 business days
  • Final resolution: within 7–14 business days (depending on complexity)

Itemo may require evidence, additional photos or written accounts from either party.

10. Amendments & Updates

Itemo may update this Listing Policy from time to time to reflect:

  • Legal or regulatory changes
  • Operational improvements
  • Risk mitigation needs
  • Changing user behaviour

Notice of significant changes will be provided through the platform and associated communications.
